"fox & friends" starts right now on a super bowl sunday. ♪ >> good morning everybody. peter johnson, jr. in for clayton morris this morning. >> good morning. >> we start with the latest in egypt. protesters are packing the streets once again. now, the 13th straight day, as you can see from the live images from cairo, about two o'clock in the afternoon there. this after members of president hosni mubarak resigned including his own son. and no indication to sit down

and opposition leaders met with egypt's vice-president, but there was no break through here. the protests continue and there are signs of normalcy, a limited number of banks, stores and fast food restaurants open for the first time in a week. >> you know, that's very important because let's remember, the square has at its height. 250,000 people. well, there are 80 million egyptians, many of whom want to get back to work, many who have not been able to work and stores and banks closed, as you just said. when you get outside of the square, you hear from egyptians who say, can we get back to our lives, please, back to making money? >> we've got to put food on the table. >> anecdotally, there are a lot of egyptians, poor are egyptians and older egyptians saying let's have a transition and make sure that it's orderly and let's as you say, get back to work about the business of making bread for daily life. >> meanwhile, what's the future there in egypt. some are concerned because the

muslim brotherhood, that rather radical group, the largest opposition group there in egypt has now already held talks with the egyptian government. according to the bbc they've already met with vice-president omar suleiman and mohamed el baradei, the former head of the nuclear watch dog, iaea. how concerning is that for the future. opinions vary, but some speculate they want sharreya law in egypt. >> here are some of the things the muslim brotherhood stand for. they say they denounce violence and they have a checkered past in terms of what they have stood for and said also to be the godfather of al-qaeda. they were founded in 1928. they were banned in egypt in 1954 and in fact, omar suleiman, the ex-vice-president now made a career out of tracking down all this, considered one of their enemies and they're egypt's oldest political organization, but here is what is interesting. they want to control how women

dress. they want to segregate male and female. they want a separate curriculum for girls. forget violence for a second. the and they stand for things in terms of gender relations that we would think are backward and would not be comfortable. >> and they stand for the koran and some say they gave birth to al-qaeda. >>, but we have to respect that. >> and egypt stands for that, sharreya is the basis of egyptian law and you have to understand, also, you go back and look at 2006 poll done in egypt. 92% of the people in egypt believe that israel was their enemy, another recent poll shows that 84% of egyptians believe if you encourage in adultery you should be stoned and a similar amount says if you leave the muslim religion you should be killed. so, obviously, there is a deep-seated islamic basis in this society and the muslim brotherhood is tapping into that in a cultural and religion way and i don't think

there's any question going forward, whatever the configuration of this government is, that they're going to be playing a role. >> well, look, some say they have 30% of the vote there in egypt. that's a rather large percentage. >> no real votes over the years, there have been one party elections. >> hard to measure. >> no one really knows. >> and the muslim bror hood, officials are saying the priority is changing the regime and the transition of power to a democratic system. if we find something as sincere and the situation is good. we withdraw. that's big laboring language. if they're in power. >> yeah, hard to tell. >> the square is in the center of the protests. a fox group shows what life is like inside that square. leland vittert is live in cairo this morning. we hope all is safe for all the journalists there. we know a lot have left the country. >> there's no request a lot of people have left and there was

time where there was-- it actually felt pretty secure and we walked over there probably about a mile from where i'm standing now across the nile river. as you walk in, there was an army check point there and they were patting people down and then guns you got inside the square, the protesters themselves formed sort of this pair cade of people and they then patted you down and talked to you for a minute and obviously, they're trying to keep the pro mubarak guys out of the square. inside the square it's absolutely packed. there's a huge number of people inside there, and to the letter, every person we talked to was not happy with this idea of a slow transition and resignation for the party and this other kind of stuff and they want mubarak gone and that's the only message we kept hearing coming out of the square, but the square seems largely peaceful and a lots of protesters worked to clean up from the violence that happened earlier in this week and this is a workday in cairo and a lot of people seemed as though they were on the way to work also. a lot of people obviously were inside the protests sleeping in the square and saying

they're going to stay there until mubarak leaves. that's the message we get. they are a not happy with transitional move they simply want him gone then we'll talk. pretty amazing to be inside there and of course today is the day of martyr remembrance and trying to remember all those people killed. back to you guys. >> thanks so much, leland. >> meanwhile, former vice-president dick cheney has interesting things to say on hosni mubarak. obviously, dick cheney was in office and had to deal with hosni mubarak during the the bush presidency and basically what he said is that mubarak has been a good friend to the united states. let's listen. >> the reason why a lot-- there are good reasons for there to be, confidential shalty and some of those communications and i think president mubarak needs to be treated as he deserved over the years 'cause he has been a

good friend. >> there's no doubt that mr. mubarak and egypt has been a good friend to the united states and to israel so it kind of reflects this kind of flip-flop mode we've been in here in the united states where we're trying to encourage the people in liberation square in cairo, as we hear more and more about the muslim brotherhood, listen, we had it pretty good in terms of mubarak. how can this government transition in an orderly way that not only protects the people of egypt, but protects the people of the united states and israel? and i think the vice-president cheney is reflecting that and also reflecting the fact that we had an incredibly close relationship with the new vice-president of egypt, through the cia and egyptian intelligence over many years. >> this comes the day after the president, president obama said he's a patriot, that president mubarak is a separate. this man helped us out in the

gulf war in 1991 and several times militarily helped the region. is he a friend of the egyptian people right now? no and dick cheney did say, the future of egypt does lie with the people of egypt. the didn't necessarily support him going forward, i think looking back. >> it shows how complicated this is, how complicated a line it is for the white house to be walking right now and we'll talk more about that throughout the show and let's get to the rest of the headlines. the an iranian court has opened for the three americans accused of spying, but held behind closed doors. chene bowers, josh and sarah shourd were detained in 2009 after they allegedly crossed over in iran. shourd was released in september, but the two men remain in custody and no word whether she will return to iran for the trial or appear remotely. an iranian lawyer representing

all three. police are stepping up the search for a toddler in new baufles, texas. volunteers went door-to-door throughout the neighborhood before searching a wooded area and no sign of the little boy. if you know anything, call authorities please. they say it's for his own protection, a trip that former president george w. bush was supposed to make to switzerland has been canceled because violent protests and president bush was scheduled to speak at an israeli charity dinner in geneva, the events coordinator called it off because it would be too dangerous. they say that of president bush violated the rights of terrorist suspects. tmz says that lindsay lohan will be charged for felony grand theft for allegedly stealing a $2500 necklace. the 24-year-old faces possible six month jail sentence for violating probation and she says she merely borrowed the jewelry.

the same storm that causes problems in texas today where we've got the big game going on and good thing we're inside. 40 degrees, a few rain showers, maybe a bit of snow after the game during the overnight hours and 40 degrees. look at the rest of the country right now and we'll take a look at the satellite radar picture. across the east, parts of florida dealing with rain showers and a cold front is going to be bringing the rain showers and probably not making its way to miami if you're good for the day. but the northeast clearing out and plenty of sunshine. chicago a few snow showers as well and in the west, ran in parts of texas and new mexico, but the pacific northwest, later this afternoon we'll start to see the rain and snow move on in and that's the next storm. a big one for us, tuesday, wednesday, thursday, much to the south of here and talking about more rain, more snow, more freezing rain so a bit of a rough one and i think after that, we're going to calm things down it looks like for at least maybe five to six days, that'd be great news.

a massive group of people. this as we learn key members of the government have resigned despite president mubarak's refusal to step down. so is egypt closer to a new government? james karafano is director of foreign policies at the heritage foundation, an expert on national security and good morning, doctor. >> good to be with you. >> are we getting close are to getting this resolved and should we be concerned about the muslim brotherhood taking over egypt? >> well, what we-- we see the strategy on both sides clearly, on the government side it's the minimalist approach and give the minimum that you can to make the transition as slow as possible. on the opposition side, you see, you know, nothing is acceptable until we get rid of mubarak and we saw the first crack in that yesterday. we saw people negotiating with the government when they said they weren't going to until mubarak left and we've also soon some kind of economic

life creep back into cairo which they didn't want. whether this is a trend line we are going to go on or whether it's kind of a turning-- you know, something is going to explode from here, way too soon to tell. >> are we on the right trend line here in the united states? are we doing what we need to do to protect our interests and the interests of our allies, including israel and handling the situation right now? >> well, you know, that's really a great question. i think sometimes the problem with the white house, they are sitting at their television trying to micromanage events in egypt which of course is possible, because the stake holders in egypt are going to have the biggest thing, particularly in the army and the way forward, but lots that the administration going to be. iran is a bad actor, linked to hamas and hezbollah. hezbollah and the muslim brotherhood are kissing cousins, we should be putting the screws to iran the more you leave them alon the more dangerous they are. >> we're running out of time.

how do we put the screws to iran to protect the united states and israel in the context of egypt? >> well, you know the united states has sanctions and now the administration, people, the sanctions are actually showing some effect and what the administration is actually doing, let's back off without fully implementing things and they've got that backwards and fully implementing the sanctions there and piling more on and pushing iran back into the box and the number one thing they can do to keep the middle east more stable in addition to reaffirming our alliance and importance of israel in the region. >> our last question, are we reforming that alliance in a public fashion and doing it enough? are we letting the world know we intend to stand behind israel whatever happens in egypt? >> i think that's the number one thing the united states could be doing letting everybody in the region know, nobody is going to steel a march on the u.s. alliance and it's an important ally for us and i think that would be a stabilizing factor in terms of letting people know where the united states is going to-- >> as well as finishing the

alert. you're looking at cairo, where we've learned that the muslim brotherhood will hold talks with the egyptian government for the first time in years. suggesting the fundamentalist party may have a role in a post mubarak egypt. this comes as protesters hit the streets again today for the 13th day. president hosni mubarak is hanging on and the leaders of his ruling national democratic party, including his son, have now resigned, but there are some signs of a return to normalcy. many banks, stores and restaurants open for the first time in a week. and just on a limited basis. and world leaders were wrapping up talks at the global security conference in munich germany and focus on the current president of egypt. secretary of state hillary clinton also finalized the nuclear arms treaty with russia during that meeting. the obama administration had a sometimes rocky relationship with the business community, but to create jobs the president will need their help.

caroline shively is live with more on the president's upcoming visit with the chamber of commerce. will this be a tense visit or what are we expecting? >> i think it's pretty tense alisyn. he's going to try to warm things up with the chamber of commerce tomorrow. as you've been talking about the last few years have been frosty. remember this, the group house republican win back the house with most of the the $15 billion dollar campaign budget and continues to fight the president's health care overhaul and months ago, remember this, the top presidential aide called the political move a threat to our democracy. things could be changing. election efforts for 2012 are warming up and doesn't get involved in presidential politics, but influence over voters. vot,the president needs for reelection and the president and business leaders are on the same side of the key fight. winning congressional support for training agreement with south korea and one of their own. chief of staff, bill daley, he was an executive with jp morgan chase.

joining us now is karen, the president of united teachers of dade and melissa barton a mother against tenure. thanks for being here. >> and good morning the. >> karen, i want to start with you, what's wrong with making teachers pay merit-based? >> the first thing is that teachers do not have tenure. what we have is contracts and of course, we want to adhere by our contracts. so, i just want to set the record straight on that. >> oh, okay. melissa, is that-- you've been in this game for a long time. ever since what happened to your son in kindergarten where he was voted out at the hands of his teachers, is that accurate that teacher tenure doesn't exist in florida. >> if you're technically speaking, i guess it is. let me tell you something, tenure has been around since 1917 and the idea of tenure is exactly that here in florida. despite what you want to call it, we do have tenure and it is impossible.

alert. the latest in egypt, things develop in the square. protesters have hit the square again in egypt and this is the 13th straight day. president hosni mubarak resisted any calls to resign, but members of his ruling party have quit, including mubarak's own son, reports at one time, the heir apparent to him and opposition leaders met with egyptian vice-president omar suleiman. >> there's signs that life is slowly getting back to normal for some of the 80 million residents. banks are open and limited basis and many stores and restaurants also opened their doors for the first time in a week and we discussed it this morning, that's an important step. there are so many millions of egyptians that want and need to get back to life. they need to put food on the table. they want this democracy, they want their voices to be heard, but let's be honest, hey, they've got to feed their children and got to continue with life. >> now we know the muslim brotherhood is about to hold

talks with the government about a plan to go forward in egypt. we spoke earlier this morning with ed hussein, former muslim brotherhood member, and this is what he had to say. >> by constantly attacking the muslim brotherhood, of course, sometimes the right thing, and sometimes and often the wrong thing, we end up making them more popular in the arab street and parliamentary present and it's right to be critical of the muslim brotherhood because it still has a fanciful idea, some way, some day it will create an islamic state in egypt. that's the bad news. the good news is that the egyptian muslim brotherhood is no way clear what they mean by it, how it would manifest and what relations for the rest of the world. there's good news and bad news. >> well, it's not just an islamic state in egypt, as far as i understand, from what i read they want to create it from spain to indonesia. the muslim brotherhood wants

sharreya law and an islamic state through europe and the middle east and it's complicated. as we heard from our guest he was a former member of the muslim brotherhood and he said basically that some of the high profile members who basically graduated from the muslim brotherhood, talking about al-zawhiri that they left because the muslim brotherhood was not radical and violent enough for them. >> yeah, you see the slogan there, islam is the solution, it's been around since 1928 and banned though in egypt since 1954. this is the group some say created al-qaeda, a group that you don't want anywhere near the leadership of government, but they represent between 20 and 30%, according to estimates, of egyptians. they do say they will not run anyone for president to replace president mubarak and in fact, they do say to the new york times, we are standing for a real democracy, with general freedom and a real sense of social justice.

>> welcome back to "fox & friends," super bowl sunday. ronald reagan's 100th celebration going on. plenty of news as well. >> let's get to the headlines, there's a closed door trial for the hikers accused of spying in iran and begun with two of the hikers in court. and we go live to amy kellogg with the details in london. >> hi, alisyn, our understanding is that the hearing today is over and i don't know whether that means that some decision has been made or whether this is being

carried over, but our understanding is that the hearing is done for today. now, the lawyer for the hikers, iranian lawyer on the ground there in the courtroom, phone is switched off as of five minutes ago and i just spoke with an iranian colleague and other journalists in iran who is trying to get information as well and he understands this is done for the day, but no information yet. of course, the hikers are being accused of being american spies and that's something that they have denied and something that the u.s. government, alisyn, repeatedly denied and even iranian lawyer said they are completely innocent. now, this hearing today, which is being called the trial was held, as you mentioned behind closed doors and something called the 15th branch of the revolutionary court. the two hikers, josh and shane, were inside, along with their lawyer, but the swiss ambassador, who represents u.s. interests in iran, because tehran and washington don't have formal relations, was not allowed to go inside.

now, they were of course picked up in the summer of 2009, just a little background when they allegedly strayed into iranian territory while hiking in iraqi kurdistan and taken into custody by iran's revolutionary gored. the three hikers, sarah shourd, included in that group were reunited back in may of last year and sarah shourd was released on bail because she was suffering from some health problems and iran requested, alisyn, that she return to face charges and she has not returned. again, this is wrapped up today and i spoke with someone who has been very close to the proceedings, the back and forth between washington and tehran on this. he said that he thinks in a sense, it is a good thing for the judiciary to be out of this at some point soon so that the executive branch like the president wants to pardon these guys, he can. back to you, alisyn. >> let's hope that this ends with an outcome with them coming home. >> absolutely alisyn. >> thank you for the update,

with the vice-president is momentous development. >> momentous in what way and b, is it frightening to israel and the united states that they have so much capacity now for power and leadership in that country? >> momentous because the regime. the mubarak regime has stood for stability and keeping the islam and muslim brotherhood-- the muslim brotherhood for its part is breaking ranks with all those on the street who say they won't negotiate with the vice-president until hosni mubarak is gone and both sides, i think, major concession, where this leaves us, i can't tell you, but it's very important itself. is it dangerous, yes, very dangerous for all concerned. but more broadly, two great blocks in the middle east. iranian backed revolutionary and the saudi-backed, egypt is a major element in the-- it's now in danger of moving into the iranian block.

organization has been basically banned in egypt for many, many years. earlier this morning, ed hussein, a former muslim brotherhood member, talked about the good and the bad within the group and how we should be viewing their participation, now. >> by constantly attacking the muslim brotherhood, sometimes the right and sometimes the wrong thing, we make them more popular on the arab street where they'll have a significant parliamentary presence but it is right to be critical of the muslim brotherhood because it still has a fanciful idea that it will someday create an islamic state in egypt and that is the bad news. but the good news is the egyptian muslim brotherhood is no way clear as to what they mean about it and how it woman fest with relation to the rest of the world. >> alisyn: and i read it is not just an islamic state in egypt,

they want an islamic empire and there are a lot of question about that but the fact it happened in 13 days, it was previously unthinkable 14 days ago, the to the lawed group, some say the godfather of al qaeda, though he said we shouldn't vilify them, it strengthens their resolve, in two weeks that it happened in egypt is astonishing. >> dave: but he brings up a good point, if you keep them out and they are 20 to 30% of egypt, what happens then, if you keep out you might be looking at a more dangerous situation than try the bring them in, they say they will not run anyone for president to replace president hosni mubarak and say publicly they want real democracy as well. >> alisyn: if that means separating and segregating girls and boys in school and giving girls a different curriculum and waving women wear what they tell them to. that is a different kind of

likely be. higher, that is, than if benefits and other valuable -- >> alisyn: sure, but when you say other valuable benefits, i know women whose can taontact l are government and allergy shots are covered but not the treatment to have a baby they desperately want. >> they have luxury health plans and would make sense for insurance companies to add benefits to their plans for people who have those benefits, like the contact lenses included, but for individuals who want more basic treatment that is more affordable for example that would provide catastrophic coverage and one of the -- it makes sense to exclude those benefits for the purpose of pricing. >> alisyn: what is your response? obviously it is about price yet i know you think this is a vital need? >> well, of course it is, alisyn, having children is fundamental to the human condition. and a choice that we make that separates us from animals, desire to have children, clearly essential and a life-sustaining

action and, more importantly, what michael's argument is, numerous studies have shown including infertility coverage in health care packages actually lowers the overall cost of health care and when people don't have coverage they made bad medical choices. for example, i woman might choose to do an intra uterine insemination, instead of a more expensive procedure and the incidence of multiplings, is more of a risk, and, the cost of multiples, premature deliveries and long nicu stays, and, the things associated with that is far more expensive and several

studies show in new jersey and massachusetts, which have the best, the premier infertility coverage in the country that costs went down after infertility treatment was mandated. >> alisyn: and we have -- at the moment the way it works, 15 states, basically infertility coverage is decided state by state and 15 states have some level of coverage though it is often on aed inadequate because, for ivf, it is $12,000 a pop, and one ivf treatment, rarely gets the job done. michael, quickly, do you consider fertility and having a child a vital medical need? >> i don't think it is a vital insurance benefit and two points/want to make, quickly. the first among the 15 states, none of them is likely a model for quality health care, and fiscal responsibility. there is no model of that nature in the nation and we also, in this debate have been ignoring the fact that the biggest question that has been plaguing domestic politics over the past two years is how to provide

>> alisyn: in fact i should mention you covered anwar sadat's assassination and the aftermath of that in 1981. were you surprised to hear the muslim brotherhood is now meeting with the vice president, omar suleiman? >> i was, actually, because the opposition so far has refused to meet with vice president suleiman and their condition is that, first hosni mubarak has to step down and so you have a break from the opposition with the muslim brotherhood going ahead and conducting these meetings. showing the opposition is not really unified. >> as americans we are always ecstatic at the prospect of any people who have been repressed finding democracy. the people in egypt, 80 million of them, will they find democracy as a result of the 13 days of protests or find something else? >> well, we don't really know yet. we do know that hosni mubarak is on his way out. he had said he will not run

again in september and that his son, gamal, all will not run. in effect, the vice president, omar suleiman, is in charge of the government right now and he's the one make decisions. and what he asked of the west and the west has agreed, is to let him conduct an orderly transition where he makes constitutional changes, and meets with opposition groups, so they can pave the way for a fair and democratic election, come september. >> alisyn: obviously, it also makes westerners and americans nervous to think the muslim brotherhood will be in some position of power, when we know their repressive views of women for one and lots of things, is that what will happen there. >> if you were to have an election right now in egypt, the muslim brotherhood would probably win anywhere between 20 and 30%. the fact that so many other
